A Massive Win for the Rule of Law and Arizona’s Economy

In a Nutshell

On Friday, the U.S. Supreme Court took a definitive stand in upholding our democracy. In a 6-3 decision, the Court ruled that the Trump Administration’s trade tariffs were unlawful under the Constitution.

Specifically, the Court rejected the argument that a loophole in the International Emergency Economic Powers Act (IEEPA) granted the President the power to unilaterally impose tariffs. The ruling reiterates what the Framers intended: Congress, and only Congress, has the power to levy taxes and duties.

The Road to Victory

The legal battle began in April 2025, when Arizona Attorney General Kris Mayes co-led a multistate coalition to block the tariffs. At today’s press conference, Mayes recalled the moment the challenge was born during a town hall with Oregon Attorney General Dan Rayfield:

“We looked at each other and said, ‘This is illegal, and we can fight it.’”

Mayes added: “The statutes the President relied on simply do not authorize him to impose these tariffs. Thanks to the lawsuit filed by our coalition... today, these tariffs have been struck down.”

The Real-World Impact

In October 2025, I had the privilege of attending a roundtable discussion Mayes held with local business owners. The stories were sobering:

  • Coffee shop owners described costs spiking so dramatically they were forced to choose between raising prices or laying off staff.
  • Furniture retailers explained how tariffs on imported materials were stifling their ability to operate.
  • All echoed a singular theme: market instability and uncertainty were threatening their growth and future.

Looking Forward

“I'm relieved for our economy and for every Arizonan who has suffered under these tariffs. I'm relieved that, hopefully, this will bring down the price of groceries in Arizona,” said Mayes.

While it’s still early to know how or when the federal government will issue refunds, one thing is certain: The rule of law is worth fighting for. American democracy is worth fighting for. I couldn’t agree more.
